A 15-year-old Lapwai boy has been charged with two counts of rape and his 13-year-old brother with a single count of forcible sexual penetration with a foreign object. Buck Wayne Basey, 14 when the incident allegedly occurred on Oct. 19 at a Lapwai residence, was scheduled for trial Jan. 12. Kenneth W. Basey, 13, faces a Jan. 19 trial. He is charged with digital penetration. Both are being tried in juvenile court at Lewiston. Court documents show that five or six boys reportedly were present or participated in various kinds of sexual contact from fondling to oral sex and penetration with a 17-year-old girl. The court file says the girl was incapable of giving legal consent because of temporary unsoundness of mind stemming from alcohol consumption. Nez Perce County Sheriff's Cpl. Doug McPherson said in his report that tribal police indicated they would assume jurisdiction over involved tribal members.
