State lawmakers who banned video poker in North Carolina had an idea that the Eastern Band of Cherokee might prove to be the sticking point in their efforts. To protect the tribe from losing its gambling rights, they not only exempted the Cherokee but also added a kind of self-destruct mechanism to their 2006 law that would cancel the whole law if a court ever ruled the ban must apply to the tribe.
