- The U.S. Supreme Court has dealt a major blow to Navajo Nation water rights. In a shocking decision, the high court ruled 5 to 4, that the Treaty of 1868, does not require the federal government to secure or provide water to the nation. According to Justice Neil Gorsuch, the core of the case was to ask the federal government to assess the nation’s rights to the mainstream of the Colorado River. The court majority ruled the federal government doesn’t have to do this. And added that it doesn’t have to provide water infrastructure either. With decades of drought, water rights have become vital for the nation.

The question before the court was whether or not tribal governments were included in the definition of governments in the Bankruptcy Act. Tribal governments are not explicitly listed in the act. The court’s ruling means that tribal governments, like all other governments, cannot use sovereign immunity in Bankruptcy Court proceedings.
